the conference of Allied Controllers held in London in

October 1920, which were forwarded to you under cover of m

letter Y 2323/66 of the 22nd November 1920 for transmission

to Controliers of local Clearing Offices.

4. I am to state that in the Controller's view no per

interest could be claimed in either of the cases quoted in

the final paragraph of the Governor's despatch.

I have the honour to acknowledge the receipt of your

letter (Tgb. Br. 665) of the 25th ultimo, enclosing a copy

of a communication from the President of the German Clearing

office dated the 3rd August, 1920. I have considered the

proposals therein contained and, beth in regard to questions

of nationality and residence, I should be willing to adopt

the course proposed in the first portion of that communication,

namely that, upon objection being taken by either Clearing

Office to a claim upon the ground that the debtor is not

a national of the country concerned or that he was not

resident in that country at the date of the ratification of

the Treaty, it should be open to the Creditor Clearing Office

concerned to temporarily withdraw the claim and to re-submit

it at a future date, any liability for the penal rate of

interest being treated as if the claim had been then put forward

for the first time. This would not prevent the liability

attaching in the case of an absoluto rejection from the expiration of the time allowed by the Article in the case of any claim which was not so temporarily withdrawn by the

Clearing Office concerned,

It would, however, be necessary to fix some limitation

to the period within which claims so temporarily withdrawn

may be re-submitted, and I would suggest that a period of twelve months from the date of withdrawal would be sufficient

for the purpose.
